This paper examines how the separation of powers at the
local level affects the efficiency of public administration in
Uzbekistan. It highlights recent constitutional reforms and the
growing role of representative bodies in balancing executive
authority. Drawing on legal analysis and expert commentary, the
study offers a critical appraisal of governance mechanisms and
proposes structural improvements to strengthen democratic
practices and administrative responsiveness.

на местном уровне на эффективность государственного
управления в Узбекистане. В ней освещаются недавние
конституционные
реформы
и
возрастающая
роль
представительных
органов
в
уравновешивании
исполнительной власти. Опираясь на правовой анализ и
экспертные
комментарии,
исследование
предлагает
критическую оценку механизмов управления и рекомендует
структурные улучшения для укрепления демократических
практик и повышения административной отзывчивости
.
INTRODUCTION
In the formation of a legal state, the effectiveness of local government plays a central
role. In Uzbekistan, local authorities serve as a conduit for expressing the interests of the
population and upholding democratic principles. As Maxmudov (2020) explains,
representative bodies at the local level are essential in executing legislation, promoting
local development, and integrating individual, social, and governmental interests. These
functions reflect the importance of maintaining a balance of powers to ensure responsive
governance.
METHODS
The study is based on normative legal analysis, supported by constitutional review
and academic literature. The methodology includes examining Uzbekistan’s Constitution
(2023), legal acts, presidential decrees, and academic writings by domestic and foreign
scholars, such as Maxmudov, Shugrina, Maslovskaya, and Yaqin. By comparing
institutional responsibilities and governance outcomes, the study evaluates how the
balance between executive and representative branches impacts local administrative
performance.
RESULTS
Recent legislative and constitutional developments in Uzbekistan have significantly
altered the structure of local governance. The 2023 Constitution formally abolished the
dual role of the khokim as both executive leader and chair of the local council. This
structural change reinforces the principle of checks and balances, allowing representative
institutions to function independently and oversee executive activities more effectively.
The legal scope of representative bodies has expanded. Councils now have the

Hear reports from executive agencies regarding compliance with laws and policy
execution;
•
Summon heads of law enforcement, health, and other key sectors to report on their
performance;
•
Receive annual reports from judicial authorities to ensure legal compliance and
protection of citizens’ rights.
Moreover, since 2019, the appointment of regional and local governors has required
confirmation by the relevant councils, a practice aimed at enhancing accountability and
local oversight (Presidential Decree, 2019).
DISCUSSION
These reforms signify a shift towards institutional independence and a more
balanced distribution of power. Shugrina (2018) and Maxmudov (2019) both underscore
that democratic governance is only possible when local representative bodies can
constrain executive authority through legal mechanisms. However, coordination
challenges and a lack of administrative capacity continue to hinder effective governance.
According to Ahmedshaeva (2013), the introduction of the governor system
contributed to modernization and improved administrative efficiency. Nevertheless,
unresolved social and economic challenges persist, partly due to inadequate
inter-agency cooperation and vague role definitions. Effective governance demands
institutional clarity, efficient oversight, and participatory decision-making.
The decentralization of functions from the center to the local level must be
supported by structural reforms that empower councils, promote transparency, and
improve responsiveness. Institutional accountability, reinforced by clear constitutional
guidelines and active political participation, is essential for strengthening democratic
legitimacy.
CONCLUSION
The constitutional enshrinement of the separation of powers at the local level in
Uzbekistan represents a meaningful step toward effective governance. However,
the realization of democratic control and administrative efficiency depends on
further institutional reforms. By reinforcing the role of local councils, improving executive
accountability, and fostering cooperative intergovernmental relations, Uzbekistan can
better align local governance with constitutional values and public expectations.
