Судебная медиация как инструмент разрешения отраслевых споров: потенциал внедрения в спортивной сфере Узбекистана
This thesis examines the potential for implementing judicial mediation in resolving sectoral disputes, with a particular focus on the sports sphere in Uzbekistan. The research analyzes the theoretical and legal foundations of mediation, international practices in pre-trial settlement of sports conflicts, and the prospects for institutional development of judicial mediation in the national context.
The study explores the specific nature of sports disputes, existing challenges in their resolution through judicial and extrajudicial means, and proposes legal and organizational measures to integrate mediation procedures into the dispute resolution system among athletes, clubs, and federations. Special attention is given to the possibility of establishing specialized structures for sports mediation in Uzbekistan.

Findings show that the United States and Japan retain a limited-liability model in which platforms remove infringing content after notice, whereas the EU has adopted a hybrid system that imposes an affirmative duty to filter user uploads. Despite these regulatory variations, major global platforms have standardised their compliance practices by deploying similar technical solutions, effectively narrowing the gap between jurisdictions.
The conclusions confirm that a blend of legal safe-harbour regimes and proactive algorithmic control is becoming the dominant trajectory worldwide. Sustainable copyright protection will require deeper international coordination, transparent notice-and-counter-notice procedures and the continual refinement of technologies that reduce the risk of over-blocking.
